Suspensión cautelar en el ámbito tributario: aclaración y matización de la doctrina jurisprudencial aplicable

La reciente Sentencia del Tribunal Supremo del 20 de octubre del 2025 (rec. cas. núm. 6341/2023) refuerza, matiza, completa e, incluso, aclara la doctrina jurisprudencial existente referida a la suspensión cautelar en el ámbito tributario y confirma que el automatismo administrativo no es trasladable sin más a la sede jurisdiccional, pero impone que la decisión judicial que deniegue la suspensión, pese a la existencia de garantía y a la previa suspensión administrativa, esté reforzada por una motivación suficiente.
