La infracción de una marca por un nombre de dominio anterior a su registro

El Tribunal de Justicia ha dictado una reciente e interesante sentencia en relación con un supuesto en el que el titular de un nombre de dominio acudió a los tribunales de justicia después de haber perdido un procedimiento ICANN (Corporación de Internet para la Asignación de Nombres y Números). Se trata de la Sentencia del Tribunal Supremo (Sala de lo Civil) núm. 1341/2025, de 30 de septiembre (ECLI:ES:TS:2025:4206).
