El Tribunal Supremo ha resuelto, por un lado, que la exoneración del pasivo satisfecho debe alcanzar a los créditos que, clasificados como ordinarios en el concurso, cuentan no obstante con garantía hipotecaria prestada por un tercero. Y, por otro, ha precisado que tal exoneración del crédito garantizado no supone la extinción de la garantía hipotecaria.
