El Pleno del Tribunal Supremo fija la competencia para adoptar medidas cautelares en casación y descarta la ejecución provisional de sentencias desestimatorias

El Pleno no jurisdiccional de la Sala Tercera de 26 de noviembre del 2025 determina que, en casación, la competencia para cautelares y cautelarísimas corresponde al órgano de instancia. Incidentalmente, el acuerdo descarta la ejecución provisional de sentencias desestimatorias para levantar cautelares, por lo que éstas se mantienen hasta su firmeza, salvo que la Administración acredite un cambio de circunstancias ante la instancia.
