Reconocimiento de la antigüedad «a todos los efectos» y tributación de la indemnización por despido (STS de 19 de julio del 2012)

La indemnización por despido que resulta de un pacto de reconocimiento de antigüedad produce efectos laborales, pero fiscalmente el exceso del importe indemnizatorio que no se corresponda con servicios efectivamente prestados no está exento ni puede gozar de reducción alguna al no merecer la consideración de renta irregular.
