Impacto de la reforma del código penal en los delitos laborales y contra la seguridad social

La regulación de los delitos laborales ha sido, tradicionalmente, muy escasa, y su repercusión práctica también. Basta consultar cualquier repertorio de jurisprudencia para comprobar esta afirmación aplicada al antiguo «delito social». El Código Penal de 1995 modernizó la regulación de este delito, pluralizándolo y agrupándolo en torno a las rúbricas de los delitos contra los derechos de los trabajadores y contra el patrimonio de la Seguridad Social, y a día de hoy el cuerpo de doctrina judicial es muy abundante y relevante.La reforma del Código Penal mediante Ley Orgánica 5/2010, de 22 de junio –que entrará en vigor el 23 de diciembre de este año- tiene una incidencia considerable en los delitos laborales y contra la Seguridad Social, y en alguna cuestión de índole más general como la que inmediatamente se comenta.
