Es contrario al derecho a la tutela judicial efectiva reconocido en el art. 47 de la Carta de los Derechos Fundamentales de la UE el emplazamiento de la matriz extranjera demandada en el domicilio de su filial en España, aunque ambas constituyan una unidad económica a efectos de la aplicación de las normas de defensa de la competencia.
