Guide to Spanish substantive law on the treatment of security interests in aircraft equipment following Spain’s accession to the Cape Town Convention and the Aircraft Protocol

The Cape Town Convention on International Interests in Mobile Equipment (CTC) and the Protocol [thereto] on Matters Specific to Aircraft Equipment (AP), both enforceable in Spain under the instruments of accession to the same, shall be jointly analysed. For the purposes that follow, we will assume that in a given case Spain is the relevant jurisdiction inasmuch as the State where the debtor is situated, the «State of registry» of the aircraft or the forum whose jurisdiction is chosen by an interested party.
