1. FLEXIBILIDAD INTERNA
A) Distribución irregular de la jornada
El RDLRML ofreció a las empresas, en defecto de pacto «en contrario», la posibilidad de distribuir irregularmente el 5% de la jornada de trabajo a lo largo del año. Ahora la LRML aumenta ese porcentaje hasta el 10%, omitiendo la referencia al carácter adverso del pacto y añadiendo que «el trabajador deberá conocer con un preaviso mínimo de cinco días el día y la hora de la prestación de trabajo resultante de aquélla».
B) Conciliación con la vida personal y familiar
La LRML amplía el art. 34.8 del ET para promover «la utilización de la jornada continuada, el horario flexible u otros modos de organización del tiempo de trabajo y de los descansos que permitan la mayor compatibilidad entre el derecho a la conciliación de la vida personal, familiar y laboral de los trabajadores y la mejora de la productividad en las empresas». El lógico enlace con el párrafo precedente hace pensar que se trata de un derecho del trabajador canalizable a través de la negociación colectiva o el acuerdo individual.
