La impugnación de dos despidos colectivos en dos empresas interrelacionadas (Vodafone y ONO) ha permitido recientemente a la Audiencia Nacional (SAN de 18 de enero del 2016, Ar. 15705) establecer una serie de criterios de interés en relación con esta figura:1. Necesidad de solicitar durante el periodo de consultas información sobre la extinción de contratos de trabajo previos al despido colectivo

Ante la alegación de la existencia de una serie de despidos previos, la Audiencia advierte que, puesto que los sindicatos —ahora impugnantes— no solicitaron en el periodo de consultas información sobre las causas extintivas de los contratos esgrimidos —habiendo aportado la empresa todos los informes solicitados por la representación de los trabajadores—, no procede ahora efectuar tal alegación…
