Gonçalo Jardim comments on proposal to create a Specialised Arbitration Court | Jornal de Negócios

Gonçalo Jardim, Litigation and Arbitration associate, reflects on the Government’s proposal to create a Specialised Arbitration Court for small and medium-sized disputes between citizens or companies and the Public Administration, with decisions within six months, in a Jornal de Negócios article.

Gonçalo Jardim believes this is a ‘very positive measure, as it aims to address the chronic problem of the slowness of administrative justice in Portugal.’ The lawyer believes that ‘we can have quick decisions if these courts are equipped with the human and material resources necessary for the speedy processing of cases.’

However, Gonçalo Jardim points out that ‘Despite some positive proposals, the Government’s Justice Programme leaves out essential measures’, warning, in particular, that ‘the performance of some judicial proceedings by representatives via videoconference should be legally provided for’, and further emphasising that it is ‘essential to strengthen the specialised training of magistrates and judicial officials’.
