Gómez-Acebo & Pombo welcomes Pablo Muelas as coordinating partner for the Insurance and Pension Funds practice

Gómez-Acebo & Pombo (GA_P) strengthens its Insurance and Pension Funds practice with the addition of Pablo Muelas as coordinating partner for the area.

Pablo has extensive experience in regulatory and corporate law in the insurance and reinsurance sector. As an active State Insurance Inspector, he has been Deputy Director General of Insurance and Regulation at the Directorate General of Insurance and Pension Funds (DGSFP), a national expert at the European Commission, and a representative of the Administration on the boards of insurance companies.

In the private sector, he has advised national and international insurers on corporate transactions and strategic alliances, participated in the creation of multi-jurisdictional insurance structures, designed and updated insurance products, advised on litigation involving insurance contracts, arbitrated in reinsurance disputes, participated in innovative insurance distribution models, and advised underwriting agencies and Insurtech companies. Finally, Pablo regularly assists in authorisation and supervision proceedings before the DGSFP.

Pablo is recognised by the most prestigious international legal directories, such as Chambers & Partners and Legal 500.

His appointment is in line with the firm’s objective of continuing to strengthen its Insurance group, which also includes Ana Martínez-Pina, as coordinating partner for Financial Regulation, and a group of partners and associates from different practice areas, who provide cross-cutting legal advice on all matters relating to insurance and reinsurance companies.

How does the Customer Services Act 10/2025 of 26 December affect insurers?
Act 10/2025 amends Act 44/2002 and requires the updating of regulations for customer services. It comes into force on 28/12/2025, with a twelve-month adaptation period. It enhances accessibility and personalised assistance; it prohibits answering machines and call forwarding from toll-free numbers to paid lines. It requires the separation of customer services from commercial functions and specialised staff training, including assistance to vulnerable groups. It also expands customer information, prohibits complaints by telephone and allows co-official languages. It also establishes acknowledgement with an identification code and new grounds for non-acceptance; sets a deadline of one month for resolving complaints to customer services and ninety days for complaints to the Directorate-General for Insurance and Pension Funds, and specifies the requirements for acceptance.

Financial institutions’ customer services following Act 10/2025
Act 10/2025 reforms the regime governing financial institutions’ customer services and introduces a procedure for the submission, processing and resolution of complaints filed by their customers, including special provisions when such customers are consumers, such as a free helpline and the availability of channels that allow for personalised service to vulnerable consumers or people without access to certain basic financial services that are not defined in the new law.

Payment service providers’ rectification of unauthorised or incorrectly executed payment transactions: user obligations
The Court of Justice of the European Union (Fourth Chamber), in its judgment of 1 August 2025, case C-665/23, IL v. Veracash SAS, concludes that a payer is deprived of the right to reimbursement of the amount of an unauthorised transaction if he or she delayed in notifying his or her payment service provider of the unauthorised payment transaction, even though he or she did so within 13 months from the debit date. This interpretation of the Payment Services Directive is applicable in Spain (Art. 43 RDL 19/2018) and appears to be retained in the future Regulation on payment services.
