Gómez-Acebo & Pombo Featured in The Legal Industry Reviews: Spain

Ana Martínez-Pina, partner in the Banking and Finance practice at Gómez-Acebo & Pombo, along with the Firm, feature prominently in the latest edition of The Legal Industry Reviews: Spain.

In her commentary, Martínez-Pina highlights that on 30 September 2025, the European Commission unveiled the “Savings and Investment Account” (SIA), an initiative designed to encourage individual savings and support corporate financing, particularly for SMEs.

She notes that the SIA aims to make investment more accessible to European citizens, especially retail investors, through a user-friendly account offering a diverse range of products within an attractive tax framework. Its benefits include fostering savings, providing returns above traditional deposits, and allowing risk diversification across multiple products, while retaining sufficient liquidity for unforeseen needs.

Martínez-Pina concludes that, if effectively implemented across the EU, the SIA could play a significant role in channeling investors’ funds towards corporate financing.

The publication also highlights Gómez-Acebo & Pombo’s advisory work for BayWa r.e. EMEA Projects Spain in the sale of the Gerena II (50 MWp) and Chamorro (10 MWp) photovoltaic projects, located in Guillena, Seville, to KGAL Investment Management. The specialised energy team was led by partner Verónica Romaní, alongside Diego Martínez, Laura Rey, and Mónica Sebares.

Payment service providers’ rectification of unauthorised or incorrectly executed payment transactions: user obligations
The Court of Justice of the European Union (Fourth Chamber), in its judgment of 1 August 2025, case C-665/23, IL v. Veracash SAS, concludes that a payer is deprived of the right to reimbursement of the amount of an unauthorised transaction if he or she delayed in notifying his or her payment service provider of the unauthorised payment transaction, even though he or she did so within 13 months from the debit date. This interpretation of the Payment Services Directive is applicable in Spain (Art. 43 RDL 19/2018) and appears to be retained in the future Regulation on payment services.
