GA_P advises Carmila España on the purchase of a shopping mall

Gómez-Acebo & Pombo has advised Carlima España, S.L.U., on the purchase from a SOCIMI (confidential) of the shopping mall comprising 121 registered properties in the “La Rosaleda” shopping centre in Málaga, for a total amount of over 24 EUR millions.
The properties acquired are in operation under lease agreements signed with more than 55 leading operators. In addition, the seller’s liability under the aforementioned sale and purchase has been structured through the subscription of an R&W insurance policy.
The following have advised on the transaction: Natalia Lastres, Real Estate Counsel, Marta González-Llera, Real Estate Senior Associate and Javier Marroquín, Paralegal.

Continuing or permanent building damage and risk of no limitation period (Supreme Court (Civil Division) Judgment no. 1463/2025 of 21 October 2025)
With regard to actions under the Building (Unified Regulation) Act, the Supreme Court reaffirms that there is no continuing damage, but rather permanent damage. The solution is more efficient for all parties, as well as fairer. Also cheaper for the judicial system.
