Despite geopolitical uncertainty and electricity price volatility, activity in this area is expected to increase and most expect further market growth.

One of the other factors to take into account in this practice is the definitive administrative operating authorisation (AAE). ‘This year, some of the renewable generation projects under development will be close to the deadline for compliance with the milestone of the administrative operating authorisation provided for in Royal Decree-Law 8/2020,’ explains Borja Carvajal, partner of Public Law and Regulated Sectors.

The proximity to this milestone has led in some cases to difficulties in the financing of projects that had already acquired ready-to-build status. ‘It will be very important for the sector how the government responds in cases where there may be slight delays with respect to this milestone, as it will set a precedent on which developers and financial institutions will make their investment and project financing decisions,’ says Carvajal.
