Our partner Miguel Lamo de Espinosa, in a report and a previous interview in Capital & Corporate magazine, talks about the reform of the insolvency law and how it will affect the market in view of the expected arrival of a wave of restructurings.

“The new legislation aims to facilitate the maintenance of the company and its activity, which is the real objective. Basically, it allows greater flexibility in imposing restructuring agreements on certain creditors and even partners, so that operations that save the company cannot be blocked. This is very important, because it is unprecedented in Spain”.

Interruption of limitation period in respect of non-sued (eventually jointly and severally liable) co-debtors (Supreme Court Judgment no. 1496/2025 of 27 October 2025)
