Viabilidad de la acción declarativa de responsabilidad de daños producidos por un contagio que se manifiesten con posterioridad y el problema de su prescripción

Se expone la doctrina del Tribunal Supremo sobre una acción de responsabilidad extracontractual que se identifica con la prevista en el artículo 219.3, inciso segundo, de la Ley de Enjuiciamiento Civil y está sometida al plazo de prescripción de un año a contar desde que el perjudicado tuvo conocimiento del daño.
