Veinte criterios sobre terminación empresarial del contrato durante el período de prueba

Una reciente sentencia constitucional (STC 10 octubre 2013) desestima el amparo solicitado por trabajadora embarazada cuyo contrato había extinguido la empresa durante el periodo de prueba. Constituye un buen pretexto para contextualizar su doctrina y recapitular los principales criterios sentados por nuestros Tribunales; con una advertencia muy importante: la necesidad de examinar a fondo todas las circunstancias concurrentes en cada caso y evitar la aplicación maquinal de lo dicho en cualquier caso anterior.
