1. El abuso en la utilización sucesiva de los contratos de duración determinada

1.1. Según los datos actualizados a principios de marzo y facilitados por el Ministerio de Empleo?y?Seguridad?Social,?en?España?existen?14?483?100?asalariados,?de?los cuales?10?972?000?están?contratados?por tiempo indefinido y 3?511?100 son titulares de un contrato de duración determinada (24,2 %). Eso sí, de los 2?594?700 contratos celebrados entre enero y febrero de este año, 240?500 son de duración indefinida y 2?354?200 de duración determinada (91,3 %).Nuestro ordenamiento establece que la contratación de duración determinada (temporal) ha de ser causal, esto es, únicamente por las razones tasadas en la ley (principalmente, para obra o servicio determinado, eventualidad o interinidad, ex articulo 15 del Estatuto de los Trabajadores, en adelante, LET). La inadecuación del objeto del contrato a la causa legalmente establecida o el empleo de un contrato temporal para una actividad no coyuntural, sino permanente, y, sobre todo, la utilización sucesiva de diferentes modalidades temporales para atender una actividad estructural de la empresa suponen una actuación en fraude de ley, sancionada con la consideración de la relación laboral como indefinida…
