Utilización por parte de la Administración de un producto sanitario defectuoso: el Tribunal Supremo reitera su jurisprudencia

El Tribunal Supremo (Sala de lo Contencioso) —en su Sentencia núm. 1423/2021, de 1 de diciembre de 2021 (ECLI:ES:TS:2021:4521)— ha reiterado su jurisprudencia (sentada en las sentencias de 21 de diciembre de 2020 (rec. 803/19), de 21 de enero de 2021 (rec. 5608/19) y 28 de enero de 2021 (rec. 5467/19), según la cual no cabe atribuir a la Administración sanitaria la responsabilidad patrimonial derivada de la utilización de un producto sanitario defectuoso, cuya toxicidad es alertada con posterioridad a su aplicación en una intervención quirúrgica.
