1. Enfermedad y discriminación laboral

Hasta ahora se ha venido sosteniendo que el trabajador enfermo queda al margen de las normas antidiscriminatorias. Se descarta la enfermedad como factor discriminatorio pues ni aparece mencionado como tal (Constitución, Directivas Comunitarias, Tratados Internacionales, Leyes laborales internas) ni puede subsumirse en las circunstancias genéricamente aludidas por aquéllas.Así lo han venido sosteniendo sentencias comunitarias (STJUE 11 julio 2006; Chacón Navas) y constitucionales (SSTC 207/1996; 160/2007) pues una cosa es el derecho a la integridad corporal y otra el derecho a la salud. Corolario de estos planteamientos ha sido la jurisprudencia de la Sala Cuarta:
