Subrogación laboral sin sucesión empresarial supone ausencia de responsabilidad: una cuestión de prueba

Ante una subrogación laboral derivada de convenio, la aplicación del art. 44 LET requiere que el demandante pruebe que la actividad pivota esencialmente en la mano de obra o que se han transmitido medios materiales, aun cuando la empresa entrante se subrogue en todo el personal.
