La Sala de lo Contencioso interpreta que el artículo 130.1 de la Ley de Contratos del Sector Público sólo admite la subrogación convencional si está incluida en el sector de la actividad externalizada, impidiendo cláusulas de subrogación laboral en los acuerdos colectivos del sector público.
