Subrogación de la aseguradora del destinatario en la cláusula de sumisión contenida en un conocimiento de embarque

La cláusula de sumisión a tribunales contenida en un conocimiento de embarque es oponible al destinatario de las mercancías y su aseguradora, que no la negociaron, si, de acuerdo con el Derecho aplicable según las normas de conflicto del tribunal que conoce del asunto, se subrogan en la posición del cargador.
