El Tribunal de Justicia —en su Sentencia de 16 de septiembre de 2021, The Software Incubator Ltd, C 410/19, ECLI:EU:C:2021:742— ha declarado que el «el concepto de “venta de mercancías” a que se refiere el artículo 1, apartado 2, de la Directiva 86/653/CEE del Consejo, de 18 de diciembre de 1986, relativa a la coordinación de los derechos de los Estados miembros en lo referente a los agentes comerciales independientes, debe interpretarse en el sentido de que puede incluir el suministro, a cambio del pago de un precio, de un software informático a un cliente de forma electrónica, cuando este suministro se facilita acompañado de una licencia con carácter perpetuo para el uso de dicho software».
