En la aplicación de los procesos individuales derivados del despido colectivo de Bankia, S. A., se han dictado sentencias contradictorias que requerían una solución unificada. En un proceso de despido colectivo que puede afectar a un total de 4500 trabajadores se han redactado cartas con el mismo contenido que han sido consideradas insuficientes por unos tribunales que han declarado el despido improcedente, mientras que otros han entendido que se ajustan a Derecho. Ahora, en un pronunciamiento dictado en unificación de doctrina, el Tribunal Supremo atenúa el rigor antes exigido por considerar que existe una negociación previa que permite a los trabajadores conocer los términos tanto de la causa que motiva el despido como de los criterios de selección de los afectados.1. En efecto, la contradicción entre estas decisiones ha sido resuelta, entre otras, por la Sentencia del Tribunal Supremo de 15 de marzo del 2016 (Ar. 994). Como ya advirtió el Tribunal Supremo, para dar cumplimiento a la exigencia legal de expresar la «causa» no basta con la mera mención del tipo genérico de causa o de la causa remota, sino que habían de consignarse las causas «motivadoras» concretas (SSTS de 2 de junio del 2014, Ar. 4218, y de 12 de mayo del 2015, Ar. 2429)…
