Sobre «cláusulas salvatorias» en contratos anticompetitivos: la STJUE en el caso Telefónica/Portugal Telecom

En dos sentencias de 28 junio 2016, el Tribunal de Justicia de la Unión Europea (TJUE) ha confirmado la resolución sancionadora impuesta por la Comisión sobre Telefónica y Portugal Telecom a propósito de una cláusula de no competencia incluida en un contrato de adquisición por la primera de la cuota de la segunda en la brasileña Vivo. Se trata de un caso bien conocido.La cláusula en cuestión establecía que «To the extent permitted by Law, each party shall refrain from (…) in any project in the telecommunication business (…) that can be deemed to be in competition with the other within the Iberian market»…
