Es una práctica común en el sector de la 1598 que la entidad financiadora y el deudor, ante un supuesto de impago, firmen un contrato privado pactando la entrega del vehículo a la entidad financiadora para que ésta proceda a la venta del vehículo para saldar la parte de la deuda que dicha ejecución cubra. En muchos casos la venta del vehículo no va precedida del requerimiento notarial que exige el artículo 16.2 LVPBM, y la tasación del vehículo y de las reparaciones necesarias se hacen conforme a lo acordado por las partes, sin intervención de fedatario público…
