¿Se puede demandar al propietario de una finca en la que se viola una obtención vegetal?

El mero hecho de que una persona sea la propietaria de las fincas en las que se realizan actos de infracción de la propiedad industrial derivada de un título de obtención vegetal, no le confiere legitimación pasiva para soportar las acciones por dicha infracción. Para tener legitimación pasiva el propietario tiene que realizar alguna de las conductas infractoras. Y si ha arrendado la finca a un tercero no sería el caso.

Así lo ha declarado la Audiencia Provincial de Murcia (Sección 4ª) en su Sentencia núm. 867/2018 de 20 diciembre (ECLI:ES:APMU:2018:2605).
