Se aplica la doctrina europea sobre empresas de trabajo temporal a empresas que, sin serlo, ceden trabajadores

El Tribunal de Justicia de la Unión Europea condiciona la interpretación legal y jurisprudencial sobre cesión ilegal de trabajadores. Entiende que la normativa europea sobre empresas temporales de empleo ha de aplicarse aun cuando se efectúe una cesión por una empresa sin autorización. Algo semejante a lo que se prevé para la cesión ilegal en la norma laboral.
