¿Resolución contractual por mutuo disenso no reclamado por ninguna de las partes?

Los riesgos de aplicar la doctrina de que si ninguno parece querer el contrato, éste se da por desistido. Esa solución no sólo es probablemente incongruente con las pretensiones de las partes, sino que cierra en falso otras opciones civiles distintas de la resolución contractual que puedan hacer valer las partes ante la desestimación de aquélla.
