Reducción de la jornada “ordinaria” y no “diaria” del trabajador

1. Una vez más, las decisiones judiciales intentan evitar los efectos pretendidos de forma declarada por el legislador con su reforma laboral. En este ocasión, se trata de la interpretación de un precepto, el artículo 37.5 del Estatuto de los Trabajadores (en adelante, LET).En virtud del mismo, los trabajadores con derecho a una reducción de jornada por razón de guarda legal de un menor o una persona con discapacidad física, psíquica o sensorial tendrán derecho a una reducción de la jornada de trabajo «diaria» entre, al menos, un octavo y un máximo de la mitad de duración de aquélla, con la correspondiente reducción proporcional del salario. Aunque la dicción anterior del precepto hacía referencia a la reducción de la jornada «ordinaria» de trabajo (diaria, semanal, mensual, anual, esto es, la fijada por las partes), la reforma de 2012 (Ley 3/2012) señaló que la reducción debía llevarse a cabo sobre la jornada «diaria» del trabajador…
