Rectificación de las operaciones de pago no autorizadas o incorrectamente ejecutadas por el proveedor de servicios de pago: obligaciones del usuario

El Tribunal de Justicia de la Unión Europea, en su Sentencia de 1 de agosto del 2025, asunto C-665/23, considera que el ordenante se ve privado del derecho a la devolución del importe de una operación de pago no autorizada cuando ha tardado en notificar a su proveedor de servicios de pago dicha operación, aunque lo haya hecho en los trece meses siguientes a la fecha del adeudo. Esta interpretación de la Directiva de servicios de pago es aplicable en España (art. 43 RDL 19/2018) y parece mantenerse en el futuro Reglamento de Servicios de Pago.
