¿Puede ejercerse la acción directa del porteador efectivo contra el cargador contractual que ya abonó al intermediario el precio del transporte concertado?

A la vista de la redacción del precepto, se habían suscitado dudas sobre si dicha acción podía ser ejercida por la parte impagada del precio del subtransporte aun cuando el cargador principal hubiera satisfecho ya los portes al cargador contractual (o a otro intermediario). El Tribunal Supremo ha respondido afirmativamente a esta cuestión en su Sentencia de 24 de noviembre del 2017…
