Prohibición de arbitrajes en el mercado único de la energía

El Acuerdo sobre la Interpretación y Aplicación del Tratado sobre la Carta de la Energía eleva a rango normativo la jurisprudencia del Tribunal de Justicia de la Unión Europea según la cual el artículo 26 del Tratado sobre la Carta de la Energía no puede ni podría servir nunca de base jurídica para los procedimientos de arbitraje en el interior de la Unión como mecanismo de solución de controversias entre un inversor de un Estado parte y otro Estado contratante.
