La aplicación del régimen de primacía requiere, en primer lugar, que un determinado producto encaje en la definición legal de medicamento, ya se trate de un medicamento por su función o de un medicamento por su presentación; y, en segundo lugar, que existan dudas sobre si también encaja en el concepto legal de otro tipo de productos (complementos alimenticios, cosméticos, etc.).
