Prioridad aplicativa del convenio de empresa por resultar anterior en su aprobación al convenio de sector: una equívoca interpretación sobre la norma aplicable

Pese a la regla general sobre la prioridad aplicativa del convenio de empresa sólo en determinadas materias, la Sala de lo Social opta por esta prioridad también en el cálculo de la indemnización por despido colectivo, más por un criterio de norma aplicable en el tiempo que como regla general.
