O despedimento por extinção de posto de trabalho e os critérios de seleção dos trabalhadores

Procurando dar resposta aos compromissos assumidos no âmbito do Memorando de Entendimento sobre as Condicionalidades de Política Económica, assinado em 17 de maio de 2011, a Reforma Laboral levada a cabo pela Lei n.º 23/2012, de 25 de junho, substituiu os critérios legais de selecção do posto de trabalho a extinguir em caso de pluralidade de postos de trabalho com conteúdo funcional idêntico por critérios relevantes e não discriminatórios a serem determinados pelo empregador. Ao nível dos requisitos do despedimento por extinção do posto de trabalho e por inadaptação, a referida lei desobrigou ainda o empregador de propor ao trabalhador um posto de trabalho alternativo disponível e compatível com a sua categoria profissional.

Porém, chamado a apreciar a conformidade constitucional deste regime, o TC declarou este regime inconstitucional com força obrigatória geral por violação da proibição de despedimento sem justa causa consagrada no artigo 53.º da Constituição da República Portuguesa…
