Novedades en la regulación de la contratación on-line con consumidores

La Directiva 2011/83, sobre los derechos de los consumidores, modifica el régimen de la contratación on-line. Se armonizan en el ámbito de la UE los deberes de información precontractual y confirmación del contrato, se amplía a catorce días el plazo para desistir y se permite desplazar al usuario los gastos de devolución del bien.

Tras una larga tramitación, el pasado el 11 de noviembre de 2011, se publicó en el Diario Oficial de la Unión Europea, el texto final de la Directiva 2011/83/UE del Parlamento Europeo y del Consejo, de 25 de octubre, sobre los derechos de los consumidores, por la que se modifican la Directiva 93/13/ CEE del Consejo y la Directiva 1999/44/CE del Parlamento Europeo y del Consejo y se derogan la Directiva 85/577/CEE del Consejo y la Directiva 97/7/CE del Parlamento Europeo y del Consejo. Esta nueva Directiva pretende incentivar la contratación a distancia y eliminar las restricciones a las transacciones transfronterizas dentro del mercado único.
