Los tribunales exigen el aviso previo como condición de validez cuando no hay acceso efectivo a la notificación en la sede electrónica

La Sentencia del Tribunal Superior de Justicia de Murcia 396/2025 anula un embargo por indefensión al omitirse el aviso previo en la notificación electrónica de la providencia de apremio. Esta sentencia sigue la línea de otros pronunciamientos judiciales que interpretan que la falta de aviso provoca indefensión y determina la invalidez de la notificación practicada, salvo que el interesado haya accedido a la notificación en la sede electrónica habilitada.
