Los límites del long arm del Tribunal Unificado de Patentes en relación con España (II): la controvertida sentencia del Tribunal de Justicia en el asunto BSH/Electrolux

En este documento se expone y se critica la doctrina sentada por el Tribunal de Justicia en su Sentencia de 25 de febrero del 2025, C‑339/22, BSH/Electrolux, ECLI:EU:C:2025:108. Aunque el litigio que está en la base de la sentencia no se ventilaba ante el Tribunal Unificado de Patentes, la interpretación del Tribunal de Justicia en la sentencia BSH/Electrolux le es igualmente aplicable al Tribunal Unificado de Patentes, toda vez que este tribunal se equipara a los tribunales nacionales de los Estados contratantes del Acuerdo por el que se crea el Tribunal Unificado de Patentes.
