El régimen jurídico de los despidos colectivos presentaba, antes del RD-Ley 3/2012, algunos signos de rigidez que fueron identificados sin ambages por la norma de urgencia y posteriormente reiterados por la Ley 3/2012, de Reforma del Mercado Laboral:
? Lentitud del procedimiento.
? Negociación/consultas desnaturalizadas, al dirigirse más al aumento de las indemnizaciones que la efectiva búsqueda de medidas alternativas a los despidos o tendentes a reducir su número.
? Criterios judiciales refractarios a la aceptación de que los despidos por causas económicas, técnicas, organizativas y productivas son también «cauce para ajustar el volumen de empleo a los cambios técnicoorganizativos operados en las empresas».
