Se analizan en este documento las principales cuestiones relativas a las partes del procedimiento, objeto de regulación en el Acuerdo por el que se crea un Tribunal unificado de patentes1. Preliminar

El Acuerdo por el que se crea un Tribunal unificado de Patentes (ATUP) no sólo se encarga de enumerar el listado de acciones para cuyo conocimiento tendrá competencia exclusiva el Tribunal. El ATUP también regula (en los artículos 46 y siguientes) los aspectos relativos a la capacidad de las partes, su legitimación activa para entablar dichas acciones ante el Tribunal y la representación con la que deben intervenir.
