La comercialización de productos de marca ajena en mercados electrónicos (Sentencia del TJUE, de 12 de julio de 2011, en el caso L’Oreal-eBay)

La venta de productos en Internet por medio de proveedores del servicio de subastas electrónicas y portales que explotan un mercado electrónico suscita numerosos conflictos en materia de marcas. Precisamente al hilo de un litigio entre L’Oreal y eBay, la Gran Sala del Tribunal de Justicia de la Unión Europea (TJUE) ha dictado una importante sentencia, de 12 de julio de 2011 (Asunto C-324/09) L’Oréal SA, Lancôme parfums et beauté & CieSNC, Laboratoire Garnier & Cie, L’Oréal (UK)Ltd y eBay International AG, y otros. Se exponen a continuación los diferentes problemas afrontados por el TJUE.
