La calificación a efectos de la determinación de la competencia y la ley aplicable: ¿acción contractual o extracontractual?

La calificación de la acción determina la norma de competencia judicial o del Derecho aplicable que debe ser utilizada en cada caso concreto. En el caso de los reglamentos europeos sobre estas materias, los criterios que se han de utilizar son autónomos, están establecidos por el Tribunal de Justicia de la Unión Europea y pueden diferir de los utilizados en la aplicación de las normas de fuente estatal.
