Cuando se aprecia una grave irregularidad en la contratación administrativa por su naturaleza laboral, la competencia es del orden social. Pero, si el cauce administrativo no está fuera de los supuestos previstos por la ley, la competencia corresponde al orden contencioso-administrativo.
