Intervención de la autoridad laboral en despidos colectivos. Criterio europeo

La desaparición de la autorización administrativa en la tramitación de los despidos colectivos en España obligó a precisar que dicha intervención no resultaba preceptiva en virtud de la normativa europea. De conformidad con esta última, tan sólo se exige intentar alcanzar un acuerdo con los representantes de los trabajadores y notificar a la autoridad laboral la intención empresarial de despedir colectivamente. Ahora, el análisis judicial de una norma griega que permite la intervención administrativa para impedir dicho despido en atención a las condiciones del mercado de trabajo, la situación de la empresa y el interés de la economía nacional, obliga a recuperar el debate sobre la autorización para despedir.1. La STJUE de 21 de diciembre de 2016 (asunto AGET Iraklis, asunto C-201/15) se plantea la conformidad a Derecho (Directiva 98/59 relativa a despidos colectivos) de una disposición nacional (griega) que supedita la realización de despidos colectivos a una autorización administrativa en función del mercado de trabajo, la situación de la empresa y el interés de la economía nacional. En virtud de la normativa nacional, si, tras la consulta con los representantes de los trabajadores, las partes no alcanzaran un acuerdo, la autoridad administrativa, mediante resolución motivada y valorando las condiciones descritas podrá «no autorizar la realización de la totalidad o una parte de los despidos programados»…
