La sentencia reciente del Tribunal de Justicia de la Unión Europea de 18 de abril del 2024 (caso Heureka) y la retroacción de actuaciones ordenada por la Audiencia Nacional y el Tribunal Supremo obligan a considerar que el plazo de prescripción no empezó a correr, como mínimo, hasta que se publicó la última resolución sancionadora de la Comisión Nacional de los Mercados y la Competencia del 2019.
