Exclusión de prueba ilícita en el proceso penal por acceso al correo del trabajador

El empleo de correos electrónicos del trabajador como prueba en el proceso penal no relativiza las exigencias de protección a la privacidad de aquél. Se protege al trabajador frente al acceso abusivo del empleador y se rechaza la prueba basada en la vulneración de derechos fundamentales en el ámbito laboral.
