¿Es realmente posible reducir el salario de los trabajadores?

Las clásicas sentencias del Tribunal Central de Trabajo de 9 y 26 de julio de 1983 y 17 de abril y 14 de junio de 1984 –doctrinalmente seguidas por las del Tribunal Supremo de 20 de marzo y 25 de noviembre de 1986- reconocieron que los trabajadores podían disponer libremente de los derechos reconocidos en las normas, siempre que tal disposición no colisionara con derechos irrenunciables. Distinguir lo renunciable de lo indisponible no es, desde luego, tarea sencilla en el terreno jurídico laboral. Aplicado al salario, no puede dudarse que el mínimo que reconoce la ley es indisponible, pero el exceso puede ser objeto de negociación (individual o colectiva) in peius. Así lo declararon, entre otras, las SSTSJ de Castilla y León (Valladolid) de 19 de diciembre de 1995 y País Vasco de 15 de noviembre de 1996 en supuestos de minoración de salarios pactados colectivamente.
